A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.

The situation stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to face human smuggling charges, he was detained in immigration custody.

In her order, the judge pointed out that the government lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

The court proceedings involve disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this claim.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in Tennessee.

The court, who was hearing his petition to deportation in a Maryland district court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
